 Abstract

Background. The existence of the institution of the family is the result of the historical evolution of social relations. The family is designed to ensure order in the life of each person, to promote the procreation and upbringing of subsequent generations. In most developed countries, monogamy is a valid family law principle that prohibits entering into a new marriage without terminating the previous one. Meanwhile, at present, the institution of the family is subject to significant transformations, which are caused by the economic changes, the development of social relations, the desire of citizens for personal autonomy. The aim of the study is to explore the historical development of the monogamous marriage and the factors that influence it. This will help to understand what forms a monogamous marriage can take in the future. At that, it is necessary to consider the possibility of derogating from the principle of monogamy in order to ensure private and public interests. Materials and methods. The study is based on the works of the specialists in classical philosophy, jurisprudence and sociology, as well as the young scientists examining modern trends in the institution of the marriage and institution of the family. The study applies the general scientific and special methods of cognition, systematic, comparative, historical, social-philosophical, modeling and forecasting methods. Results. The results of studying the historical development of the family-legal principle of monogamy are described and systematized. Conclusions. Despite proclaiming the principle of monogamy, the author comes to the conclusion that polygamy informally exists in modern Russia. The author also believes that if polygamy is recognized, the specific and topical social problems in the country could be resolved. No matter how this issue is addressed, today we can confidently assert the inclusion of the domestic monogamous family in the global evolutionary process of this institution.
